PROMOTION TERMS AND CONDITIONS

The Promoter

The promoter is: EVERYMAN MEDIA LIMITED incorporated and registered in England and Wales with company number 03883018 whose registered office is at Studio 4, 2 Downshire Hill, London, NW3 1NR.

The Promotion

The title of the Promotion is [“Apple Pay Discount”] (the “Promotion”).

You will be automatically eligible to participate in the Promotion if you use Apple Pay when purchasing a ticket for a film screening on a Tuesday through our website or the Everyman App.

When proceeding through checkout, any customer booking a ticket for a film screening on a Tuesday will be offered a 15% discount if they use Apple Pay to purchase their ticket(s). On the checkout page, ApplePay will be presented as a payment option with a note stating “Save 15% with ApplePay”. By clicking this option, a discount will be applied automatically, and you will be presented with a new total (applying the 15% discount) before confirming payment. Once the ApplePay payment goes through, you will receive a booking confirmation/receipt as is standard with all bookings, showing your total and discount applied. Participating in the Promotion

The Promotion will run from 00:01 on 24th October 2022 (the "Opening Date") to 23.59 on 17th January 2023 (the "Closing Date") inclusive.

To participate in the Promotion and receive the above mentioned 15% discount, you must purchase your ticket(s) using Apple Pay, which is only available when using an iOS device or browser. Please note that this offer does not apply to any payment method other than Apple Pay (including Google Pay).

The Promotion only applies to film tickets and does not apply to food and drink purchases, gift voucher purchases, membership purchases, or any other purchase made.

The Promotion will only apply to bookings for tickets of a film screening on a Tuesday. For avoidance of doubt, a customer can pre-book their ticket on any day of the week, but the 15% discount will only apply if the ticket they are booking is for a regular film screening on a Tuesday.

The Promotion applies to tickets for all film and event screenings.

The Promoter will not accept responsibility for any tickets purchased using the Promotion that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

By participating in the Promotion, you are agreeing to be bound by these terms and conditions.

Eligibility

The Promotion is only open to residents in the UK aged 18 years or over, except:

employees of the Promoter or its holding or subsidiary companies;

employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the Promotion or its administration; or

members of the immediate families or households of (a) and (b) above.

In participating in the Promotion, you confirm that you are eligible to do so. The Promoter may require you to provide proof that you are eligible to participate in the Promotion.

The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the Promotion.

Using a ticket bought using the Promotion

Up to and including the Closing Date, a customer will be able to participate in the Promotion and receive the 15% discount when purchasing a ticket in accordance with these terms and conditions.

Tickets purchased using the Promotion are non-exchangeable, non-transferable and no cash alternative will be offered.

A ticket purchased using the Promotion may not be claimed by a third party on your behalf.

The Promoter does not accept any responsibility if you are not able to use tickets purchased using this Promotion.

Limitation of Liability

Insofar as is permitted by law, the Promoter, its agents or distributors (and/or any of its or their employees) will not in any circumstances be responsible or liable to compensate any participant in the Promotion or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors (and/or any of its or their employees). Your statutory rights are not affected.

Data Protection and Publicity

The Promoter will only process your personal information as set out in the Privacy Policy.

General

If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Promotion.

The Promoter reserves the right to hold void, cancel, suspend, or amend the Promotion where it becomes necessary to do so.

These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
